AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN
OF PALM BEACH, PALM BEACH COUNTY, FLORIDA,
AMENDING CHAPTER 2 OF THE TOWN CODE OF
ORDINANCES RELATING TO ADMINISTRATION AT
ARTICLE III, OFFICERS EMPLOYEES, SECTION 2 -136,
SO AS TO NAME THE PUBLIC SAFETY DIRECTOR AS
THE APPOINTIVE ADMINISTRATIVE OFFICIAL UNDER
THE CATEGORY OF PUBLIC SAFETY AND ELIMINATING
THE POSITIONS OF CHIEF OF POLICE AND FIRE CHIEF;
PROVIDING THAT WHEREVER THE TERMS CHIEF OF
POLICE AND /OR FIRE CHIEF ARE NAMED IN THE TOWN
CODE OF ORDINANCES, POLICIES, RULES,
REGULATIONS OR OTHER DIRECTIVES, SAID
POSITIONS SHALL NOW BE THE RESPONSIBILITY OF
THE PUBLIC SAFETY DIRECTOR AND THE DUTIES AND
OBLIGATIONS SPECIFIED THEREIN SHALL NOW BE
THE DUTIES AND OBLIGATIONS OF THE PUBLIC
SAFETY DIRECTOR; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF ORDINANCES IN
CONFLICT; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 2 -136 of the Town Code of Ordinances relating to
Appointive Administrative Offices names under the heading of Public Safety a Chief of
Police and a Fire Chief; and
WHEREAS, the positions of Chief of Police and Fire Chief and the duties relating
thereto are compatible under the category of Public Safety; and
WHEREAS, it has been determined that it is in the public interest to amend the
Code to reflect a new single position of Public Safety Director incorporating the duties of
both Chief of Police and Fire Chief, thereby eliminating the positions of Chief of Police
and Fire Chief.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF PALM BEACH, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Chapter 2 of the Town Code relating to Administration is hereby
amended at Article III, Officers and Employees, Section 2 -136, is hereby amended to
read as follows:
"Sec. 2 ®136. Appointive administrative officers.
Pursuant to section 4.04(a) of the Charter, the following shall
constitute the appointive administrative officials of the town:
Administration:
Finance director
Director of planning, zoning and building
Human resources director
Recreation director
Deputy town manager
Assistant town manager
Public safety:
Public safety director
Public works:
Director of public works

Unless otherwise specifically provided, all other personnel of the
town constitute "employees" within the meaning of section 4.04(b) of the
Charter."
Section 2. Wherever the terms "Chief of Police" and /or "Fire Chief" are named

or referred to in the Town Code of Ordinances, policies, rules, regulations or other
directives, said positions shall now be the responsibility of the Public Safety Director
and the duties and obligations specified therein shall now be the duties and obligations
of the Public Safety Director herein appointed to fulfill such duties and obligations.

Section 3. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such

invalidity shall not affect the other provisions or applications of this Ordinance which can
be given effect without the invalid provisions or applications, and to this end the
provisions of this Ordinance are hereby declared severable.

Section 4. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Palm Beach, Florida, or parts thereof which
conflict with this or any part of this Ordinance are hereby repealed.
Section 5. Codification.

This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Palm Beach.
Section 6. Effective Date.
This Ordinance shall take effect immediately upon its passage and approval, as
provided by law.
