AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF
PALM BEACH,PALM BEACH COUNTY,FLORIDA,AMENDING
CHAPTER 6 OF THE TOWN CODE OF ORDINANCES,
ALCOHOLIC BEVERAGES, AT SECTION 6-9, RELATING TO
THE PROHIBITION OF CONSUMPTION OF ALCOHOLIC
BEVERAGES IN PUBLIC PLACES, AT SUBSECTION (3) SO AS
TO PROVIDE AN ADDITIONAL EXCEPTION PROVIDING
THAT PATRONS OF SEAVIEW PARK MAY CONSUME ON THE
SEAVIEW PARK PROPERTY, ALCOHOLIC BEVERAGES THAT
ARE SERVED IN CONJUNCTION WITH FACILITY RENTALS IN
SEAVIEW PARK WITH THE APPROVAL OF THE TOWN
MANAGER; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING
FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PALM BEACH, PALM
BEACH COUNTY, FLORIDA,AS FOLLOWS:
Section 1. Chapter 6 of the Town Code of Ordinances relating to Alcoholic Beverages is
hereby amended at Section 6-9 to read as follows:
"Sec. 6-9. Prohibition of consumption of alcoholic beverages
in public places.
Within the town, it shall be unlawful for any person to consume alcoholic beverages:
(1) On the public streets, sidewalks, highways and other rights-of-way, with the
exception that patrons seated outdoors in conjunction with a permitted
restaurant may consume alcoholic beverages.
(2) On the beaches located within the town.
(3) In public parks,
a. With the exception that patrons of the par three municipal golf
course may consume, on the par three municipal golf course
property, alcoholic beverages which are sold on the premises
of the par three municipal golf course.
b. With the exception that the patrons of Seaview Park may
consume on the Seaview Park property, alcoholic beverages that are
served in conjunction with a facility rental,with approval by the Town
Manager.
(4) In motor vehicles or trailers."
Section 2. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such invalidity
shall not affect the other provisions or applications of this Ordinance which can be given effect without
the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby
declared severable.
Section 3. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Palm Beach, Florida, or parts thereof which conflict with
this or any part of this Ordinance are hereby repealed.
Section 4. Codification.
This Ordinance shall be codified and made a part of the official Code of Ordinances of the
Town of Palm Beach.
Section 5. Effective Date.
This Ordinance shall take effect immediately upon its passage and approval, as provided by
law.
PASSED AND ADOPTED in a regular, adjourned session of the Town Council of the Town
of Palm Beach on first reading this 14th day of August, 2019, and for second and final reading on this
10th day of September, 2019.
