AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN
OF PALM BEACH, PALM BEACH COUNTY, FLORIDA,
AMENDING THE CODE OF ORDINANCES AT CHAPTER
2, ADMINISTRATION, ARTICLE III, OFFICERS AND
EMPLOYEES,DIVISION 1,GENERALLY,AT SECTION 2-
136,APPOINTIVE ADMINISTRATIVE OFFICERS, SO AS
TO DELETE THE TERM PUBLIC SAFETY DIRECTOR AND
SUBSTITUTE FOR THAT TERM THE TERMS CHIEF OF
POLICE AND CHIEF OF FIRE RESCUE; AMENDING
DIVISION 5,DIRECTOR OF PUBLIC WORKS AT SECTION
2-247,GENERAL DUTIES,SUPERVISION BY MANAGER,
TO DELETE THE REFERENCE TO THE PUBLIC WORKS
DIRECTOR BEING UNDER THE DIRECT SUPERVISION
OF THE TOWN MANAGER;FURTHER PROVIDING THAT
ALL REFERENCES IN THE TOWN CODE TO PUBLIC
SAFETY DIRECTOR SHALL NOW BE REFERRED TO AS
CHIEF OF POLICE AND CHIEF OF FIRE RESCUE;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL OF ORDINANCES IN CONFLICT; PROVIDING
FOR CODIFICATION;PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PALM
BEACH,PALM BEACH COUNTY,FLORIDA,AS FOLLOWS:
Section 1. The Code of Ordinances of the Town of Palm Beach is hereby
amended at Chapter 2,Article III.Officers and Employees,Division 1.Generally,Sec.
2-136.Appointive administretive officers,to read as follows:
"Sec.2-136.Appointive administrative officers.
Pursuant to section 4.04(a) of the Charter, the following shall
constitute the appointive administrative officials of the town:
Administration:
Finance Director
Director of Planning,Zoning and Building
Human Resources Director
Recreation Director
Deputy Town Manager
Assistant Town Manager
Public safety:
Chief of Police
Chief of Fire Rescue
Public works:
Director of Public Works
Unless otherwise specifically provided, all other personnel of the
town constitute "employees" within the meaning of §4.04(b) of the
Charter."
Section 2. The Code of Ordinances of the Town of Palm Beach is hereby
amended at Chapter 2,Administration, Division 5. Director of Public Works, Section 2-
247,General duties;supervision by manager,to read as follows:
"Sec.2-247. General duties;supervision by manager.
In addition to the duties prescribed elsewhere in this Code, the
director of public works shall have general supervision over the streets,
sewer, sidewalks and thoroughfares of the town, and of the construction
and repair thereof.
Section 3. Wherever the Town Code refers to Public Safety Director, that
reference shall now read Chief of police and Chief of Fire Rescue.
Section 4. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of this Ordinance which can
be given effect without the invalid provisions or applications, and to this end the
provisions of this Ordinance are hereby declared severable.
Section 5. Repeal of Ordinances in Conflict.

All other ordinances of the Town of Palm Beach, Florida, or parts thereof which
conflict with this or any part of this Ordinance are hereby repealed.
Section 6. Codification.
This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Palm Beach.
Section 7. Effective Date.
This Ordinance shall take effect immediately upon its passage and approval, as
provided by law.
PASSED AND ADOPTED in a regular, adjourned session of the Town Council of
