Ordinance 22-2017 Elections ORDINANCE NO. 22-2017 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF PALM BEACH, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 34, ELECTIONS, SO AS TO PROVIDE THAT THE ELECTION DATES REFERENCED THEREIN ARE CONSISTENT WITH THE AMENDMENTS TO THE TOWN CHARTER PROVIDING FOR ELECTIONS ON THE SECOND TUESDAY OF MARCH OF EACH YEAR; THEREBY RESCINDING SECTION 34-3; AMENDING SECTIONS 34-56 AND SECTION 34-119; AND RESCINDING ARTICLE IV. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PALM BEACH, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Chapter 34 of the Town Code of Ordinances titled Elections is hereby amended as follows: Section 1. Section 34-3 titled Exemption From Uniform Election Date Provisions is hereby rescinded, and Section 34-4 shall now become Section 34-3. Section 2. Section 34-56 titled Calling and Notice of Caucus is hereby amended as follows: Each year the town clerk shall call a caucus of the qualified voters of the town for the purpose of nominating candidates for mayor and the town council. Such caucus shall be held as provided by section 5.03 of the Charter and shall be called by the clerk publishing the following notice in a newspaper having a general circulation in the town on the last two Mondays in December and the first Monday in January: Notice to the Qualified Voters of the Town of Palm Beach You and each of you are hereby notified that a caucus of the qualified voters of the Town of Palm Beach, Florida, will be held in the town council chambers of the town hall at 8:00 p.m. on Tuesday, the day of January, A.D. , for the purpose of nominating a mayor and councilmembers, to be voted on at the general election to be held in the town on the second Tuesday in March. All qualified voters of the town are entitled to be present and to place in nomination such candidates as they desire. For a nomination to be effective, it must be seconded and all nominations and seconds thereto may be made only by qualified voters of the town. Dated, day of / / , 20 . /s/Town Clerk Section 3. Article IV titled Municipal Election Dates, Qualifying Periods and Run-Off Election Dates in years of Statewide or Countywide Presidential preference Primary Elections, Section 34-123 is hereby rescinded. Section 4. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can Ordinance No.22-2017 Page 2 of 3 be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 5. Repeal of Ordinances in Conflict. All other ordinances of the Town of Palm Beach, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 6. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Palm Beach. Section 7. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
