Ordinance 02-2016 Solid WasteAN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF PALM BEACH, PALM BEACH COUNTY, FLORIDA, AMENDING THE TOWN CODE OF ORDINANCES AT CHAPTER 102, SOLID WASTE; ARTICLE II COLLECTION; DIVISION 3, RATES, CHARGES, BILLING PROCEDURE; AT SECTION 102-103 COLLECTION OF DELINQUENT CHARGES; AND SECTION 102-105, BILLING FOR CHARGES; NOTICE OF DELINQUENCY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PALM BEACH, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Code of Ordinances of the Town of Palm Beach is hereby amended at Chapter 102, Solid Waste; Article II, Collection; Division 3, Rates, Charges, Billing Procedures; Section 102-103, Collection of Delinquent Charges, to read as follows: If any property owner shall fail to pay a solid waste collection bill within thirty (30) days from the mailing of the bill, the property owner will receive a second statement with past due penalties on the total outstanding account balance, including any prior penalties. If the property owner fails to pay the second billing notice after an additional thirty (30) days, the property owner will receive notice as provided by law to appear before the code enforcement board. The code enforcement board will use any of its powers to bring the solid waste collection customer to compliance including, but not limited to, directing a lien to be filed on the customer's property." Section 2. The Code of Ordinances of the Town of Palm Beach is hereby amended at Chapter 102, Solid Waste; Article II, Collections; Division 3, Rates, Charges, Billing Procedures; Section 102-105, Billing for Charges; Notice of Delinquency, to read as follows: The director shall bill the owner on a quarterly basis beginning on October 1 of each year. All fees shall be deemed delinquent thirty (30) days after the date of mailing. Unless such bills are paid on or before the due date, a ten percent penalty shall be calculated on the total outstanding account balance, including prior penalties." Section 3 Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 4. Repeal of Ordinances in Conflict. All other ordinances of the Town of Palm Beach, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 5. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Palm Beach. Section 6. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
