Ordinance 27-2015 Elections ORDINANCE NO. 27-2015 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF PALM BEACH, PALM BEACH COUNTY, FLORIDA, RESCINDING ORDINANCE NO. 19-2015 IN ITS ENTIRETY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Palm Beach County Supervisor of Elections has advised the Town that her office will not be able to conduct the Town's 2016 election unless the Town changes its election date to coincide with the Presidential Preference Primary on j March 15, 2016; and WHEREAS, on April 14, 2015, the Town Council decided to hold its own election on the regularly scheduled date; and WHEREAS, on August 11, 2015, the Town Council adopted Ordinance No. 19- 2015, authorizing the use of paper ballots designed to be manually counted for the February 2, 2016, General Election and, if necessary, the February 16, 2016, Run-Off Election; and WHEREAS, on October 13, 2015, the Town Council reversed its previous decision to conduct its own 2016 municipal elections and now seeks to change those election dates to coincide with the March 15, 2016, Presidential Preference Primary and to provide for the orderly transition of office resulting from such date changes; and i WHEREAS, the Town Council now wishes to rescind Ordinance No. 19-2015 in its entirety. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PALM BEACH, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Ordinance No. 19-2015 is hereby rescinded in its entirety. Section 2. Severability. i� If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Town of Palm Beach, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 4. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Palm Beach. Section 5. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as I provided by law.
