AMENDING CHAPTER 54 OF THE TOWN CODE OF
ORDINANCES RELATING TO HISTORICAL
PRESERVATION AT ARTICLE II, LANDMARKS
PRESERVATION COMMISSION, SECTION 54-41,
APPEALS AND REVIEW, TO PROVIDE FOR APPEALS BY
LETTER BASED UPON THE RECORD; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF
ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PALM
BEACH, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Chapter 54 of the Town Code of Ordinances relating to Appeals
and Review by the Landmarks Preservation Commission is hereby amended at Article
II, Landmarks Preservation Commission; Section 54-41, to read as follows:
The applicant or any interested party may file an appeal to the town
council on any ruling by the commission or the building official made pursuant to
this chapter. The appeal shall take the form of a letter addressed to the town
clerk and shall be based upon the record. The appeal shall be filed or made
within ten days. Appeals shall set forth the alleged inconsistency or
nonconformity with procedures or criteria set forth in this chapter. The town
council shall decide an appeal within 45 days of the filing of such appeal unless
an extension of time is consented to by the applicant, and such filing shall
suspend any building permit issued pursuant to the ruling of the commission or
building official until the town council has decided the appeal. The town council
may review any decision of the commission or the building official, and their
disposition of the matter shall be final. Appeals filed pursuant to this section shall
be based on the record of the proceedings below and shall not be presented de
novo. The time allotted for presentation of an appeal shall be determined by the
town council president.
Section 2. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of this Ordinance which can
be given effect without the invalid provisions or applications, and to this end the
provisions of this Ordinance are hereby declared severable.
Section 3. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Palm Beach, Florida, or parts thereof which
conflict with this or any part of this Ordinance are hereby repealed.
Section 4. Codification.
This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Palm Beach.
Section 5. Effective Date,
This Ordinance shall take effect immediately upon its passage and approval, as
provided by law.

PASSED AND ADOPTED in a regular, adjourned session of the Town Council of
the Town of Palm Beach on first reading this 9th day of September 2014, and for
second and final reading on this 14th day of October , 2014.
