AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN
OF PALM BEACH, PALM BEACH COUNTY, FLORIDA,
DESIGNATING AN OFFICIAL TOWN SEAL; PROVIDING
FOR PENALTIES FOR UNAUTHORIZED USE;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL OF ORDINANCES IN CONFLICT; PROVIDING
FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the current Town seal was created and has been in use since 1911;
WHEREAS, the Town Council wishes to designate its seal as an official
municipal seal pursuant to Section 165.043, Florida Statute (2013), which provides for
adoption of the municipal seal by ordinance; and
WHEREAS, Section 165.043, Florida Statute (2013) further provides that a seal
so adopted shall be entitled to the protections afforded by that statute, including that the
unauthorized use of the seal constitutes a misdemeanor of the second degree; and
WHEREAS, the Town Council of the Town of Palm Beach finds that regulating
and prohibiting the unauthorized use of the Town's designated seal serves an important
municipal purpose.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF PALM BEACH, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1, The Code of Ordinances of the Town of Palm Beach is hereby
amended at Chapter 2, Administration; Article I, In General; Section 2-1, Seal
Described, to read as follows:
(a) Seal Described. The seal of the town shall be composed of two
concentric circles, the outer circle being approximately 1'/8
inches in diameter, and the inner circle being approximately 11/4
inches in diameter. Between such circles the following words
shall appear, "Seal of the Town of Palm Beach, Florida." Within
the inner circle shall appear the picture of a coconut tree with the
following words and figures within and near the inner circle,
"Incorporated April 17, 1911." A copy of the seal of the Town of
Palm Beach is reproduced below.

(b) Adoption. The Town Council of the Town of Palm Beach hereby
adopts and designates the seal described and depicted in
subsection (a) as the official municipal seal of the Town of Palm
Beach.
(c) Use. The manufacture, use, display, or other employment of any
facsimile or reproduction of the municipal seal, except by
municipal officials or employees in the performance of their
official duties, without the express approval of the governing
body is a second degree misdemeanor, punishable as provided
in Sections 775.082 or 775.083, Florida Statutes.

Section 2 Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of this Ordinance which can

be given effect without the invalid provisions or applications, and to this end
the provisions of this Ordinance are hereby declared severable.
Section 3 Repeal of Ordinances in Conflict.
All other ordinances of the Town of Palm Beach, Florida, or parts thereof
which conflict with this or any part of this Ordinance are hereby repealed.
Section 4 Codification.
This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Palm Beach.
Section 5 Effective Date.
This Ordinance shall take effect immediately upon its passage and
approval, as provided by law.
PASSED AND ADOPTED in a regular, adjourned session of the Town Council
of the Town of Palm Beach on first reading this 9th day of September 2014, and for
second and final reading on this 14th day of October 2014.
